MANAGED CARE, LIABILITY AND GOVERNMENTAL PAYERS

Since 1996, Mr. O'Neil's legal practice has focused primarily in the areas of health law and administrative law. Mr O'Neil has extensive experience seeking and securing payment on the behalf of medical providers, hospital systems, hospitals (public and privately owned),  physicians, and pharmacies.  The Firm and Mr. O'Neil have represented not only large national hospital systems, but also inpatient and outpatient providers, psychiatric hospitals and providers, as well as individual physicians and pharmacists.  These efforts to secure proper and appropriate payment have included, but are not limited to, collection efforts and litigation against national managed care payers, group health plans, governmental payers such as Medicaid and Medicare, third party administrators, ERISA plans, workers' compensation carriers, indemnity plans, and other third party liability payers.

Mr. O'Neil also has extensive experience enforcing prompt payment by managed care payers in accordance with the Texas Insurance Code.    

Through the course of his career, Mr. O'Neil has collected millions of dollars on the behalf of hospitals and medical provider clients.  Primarily, the Firm's services are provided on a contingent fee basis.  As a result, the Firm does not receive agreed fees, unless the clients indeed secure proper and appropriate payment that is due and owed under law, contract and regulation.   

Mr. O'Neil and the Firm also have extensive experience in managed care disputes and compliance as well as drafting and negotiating managed care agreements.

WORKERS COMPENSATION

Mr. O'Neil also has extensive experience recovering payments from workers' compensation carriers and insuring that such carriers pay providers not only timely but in strict accordance with either applicable Fee Guidelines or reimbursement rates required by workers' compensation network agreements and contracts.

The Law Firm and Mr. O'Neil also have extensive experience representing clients such as medical providers and other licensed professionals before state and federal regulatory agencies, including the Texas Department of Insurance, the State Office of Adminstrative Hearings, CMS, the Appraiser Licensing and Certification Board, and other adjudicative and administrative bodies.  

Mr. O'Neil and the Firm have advised clients on federal and state regulatory compliance regarding reimbursment and licensing issues that face not only medical providers, but other licensed professionals and those in trade industries that are regulated by state and federal agencies.

Mr. O'Neil is also experienced in advising clients regarding regulatory issues faced by providers and other professionals including EMTALA, HIPAA, Stark and Anti Kick Back regulations, physician recruitment and other statutory and regulatory pitfalls faced by providers. 

In addition, the Firm has extensive experience in commerical disputes and has represented an array of small and large business entities and indiviudals in contractual and commerical disputes. 

The Firm has experience offering personal services such as preparing wills,trusts and estate planning for individual clients.  

The Firm and Mr. O'Neil has also worked closely with medical associations and other provider groups in drafting and supporting legislative initiatives, testifying before legislative and regulatory committees, and reviewing bills and proposed legislation to insure client's legal rights are fully protected.
